These Terms & Conditions (“Terms”) govern your use of the Offer2Stay platform (“Platform”), operated by Offer2Stay Ltd (a company registered in England & Wales, company number 17248175), with its registered office at 128 City Road, London EC1V 2NX, United Kingdom. By accessing or using the Platform, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use the Platform. We recommend you read these Terms carefully before registering or making any booking.
These Terms constitute a legally binding agreement between you and Offer2Stay Ltd. For questions, contact us at enquiries@offer2stay.co.uk.
In these Terms, the following words have the following meanings:
Offer2Stay operates as a marketplace connecting guests seeking accommodation with hosts offering properties. Offer2Stay is not a party to any accommodation contract between guests and hosts — we provide the technology and payment infrastructure only.
Hosts are responsible for the accuracy of their property listings, compliance with all applicable laws (including planning, licensing, and health & safety regulations), and the condition of their properties. Guests are responsible for their conduct during stays.
Offer2Stay reserves the right to remove listings, suspend accounts, or decline bookings at our sole discretion, including where we reasonably believe a breach of these Terms has occurred or is likely to occur.
The Platform is intended for users aged 18 and over. By registering, you confirm you are at least 18 years of age.
AI-assisted enquiry. Our landing page offers an optional natural-language input that uses a large language model (Anthropic Claude) to pre-fill the enquiry form with structured fields (location, dates, budget, guest count). The model may occasionally misinterpret your intent; you are responsible for reviewing and confirming the parsed fields before submitting an enquiry. Use of this feature is entirely optional and does not replace our structured enquiry form.
4.1 Posting enquiries. Guests may post enquiries free of charge. Each enquiry must accurately describe your accommodation requirements. Fraudulent or misleading enquiries may result in account suspension.
4.2 Selecting an offer. When you select a host's offer, a pre-authorisation is placed on your payment method. The host then has 24–48 hours to confirm. No payment is taken until the host confirms.
4.3 Booking confirmation. Once a host confirms, payment is processed and a booking confirmation is issued to both parties. The booking is then binding subject to the cancellation terms.
4.4 Guest conduct. Guests must comply with host house rules, treat the property with reasonable care, and not exceed the stated guest capacity. Guests are liable for any damage caused during their stay.
4.5 No guest booking fee. Offer2Stay does not charge guests a booking fee. The price you see in your booking confirmation is the total price you pay.
5.1 Listing accuracy. Hosts must ensure their listings are accurate, up to date, and not misleading. This includes descriptions, photos, amenities, pricing, and house rules. Offer2Stay may remove or suspend listings that we reasonably consider to be inaccurate or misleading.
5.2 Legal compliance. Hosts are solely responsible for ensuring their properties comply with all applicable laws, including but not limited to: planning permission, short-term rental licensing, fire safety, gas and electrical safety, and appropriate insurance. Offer2Stay does not verify legal compliance and accepts no liability in this regard.
5.3 Making offers. By submitting an offer, you confirm that the property is available for the stated dates and that you are able and willing to host the stay at the offered price.
5.4 Platform fee. Offer2Stay charges a 10% platform fee on completed bookings, deducted automatically via Stripe Connect destination charges before funds reach your connected Stripe account. Your first completed booking is entirely fee-free as a promotional offer.
5.5 Payout timing.Host payouts are released to the host's bank account 24 hours after the guest's scheduled check-in date. Funds are held by Stripe (under Stripe Payments UK Limited's e-money licence) in the host's connected account until that time. This release timing gives guests a 24-hour post-arrival window to raise any issue with the property before funds are released. Standard bank processing time applies after release.
5.6 Insurance. Hosts must maintain appropriate insurance for the property and its use as short-term paid accommodation. This typically means public liability cover of at least £2 million and, where applicable, a holiday-let or short-term-let endorsement on your buildings/contents policy. Offer2Stay does not provide insurance on your behalf.
5.7 HMRC reporting (OECD DPI). Under the Platform Operators (Due Diligence and Reporting Requirements) Regulations 2023, Offer2Stay is required to collect and annually report to HMRC certain information about hosts who are reportable sellers (including name, address, date of birth or company number, tax identification numbers, bank account details used for payouts, and total consideration paid). You agree to provide accurate information for this purpose and to update it when it changes. Failure to provide required information may result in Offer2Stay suspending your payouts or listings until compliance is achieved.
5.8 Host Agreement. Additional host-specific obligations are set out in our Host Agreement, which forms part of these Terms for users listing properties.
6.1 Payment processing.All payments are processed via Stripe Connect using destination charges. Guest payments are collected by Offer2Stay and, after deduction of the 10% platform fee, transferred to the host's connected Stripe account. By making or receiving a payment through the Platform, you agree to Stripe's Terms of Service.
6.2 Currency. All prices on the Platform are in pounds sterling (GBP) unless otherwise stated.
6.3 Security deposits. Where a host specifies a security deposit, this is held by Stripe and released to the guest within 14 days of check-out, subject to the host raising no damage claim within 7 days of check-out.
6.4 Taxes. Hosts are responsible for accounting for and paying all applicable taxes (including income tax and VAT) on income earned through the Platform. Offer2Stay does not withhold or remit taxes on behalf of hosts.
7.1 Guest cancellation. Cancellation terms are set by each individual host and displayed at the time of booking. Three standard tiers are available:
Mid-stay cancellation is not available. Guests may cancel only before the check-in date. From midnight (UTC) on the check-in date onward, the cancellation flow is closed and guest-initiated refund requests must be raised through the dispute process described in section 14. Our team reviews dispute requests within 24 hours and may approve a full, partial, or no refund depending on the circumstances.
7.2 Host cancellation. Hosts must not cancel confirmed bookings except in extraordinary circumstances. Unjustified host cancellations may result in account suspension. Guests receive a full refund.
7.3 Statutory cooling-off period. Short-term accommodation booked for a specific date or period is exempt from the 14-day consumer cancellation right under regulation 28(1)(g) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. By selecting an offer you acknowledge that the standard 14-day cooling-off period does not apply to your booking, and the host's cancellation tier set out at 7.1 governs instead. This does not affect your statutory rights where the host materially misrepresents the property.
7.4 Force majeure.Neither Offer2Stay, the guest, nor the host is liable for failure to perform due to events outside that party's reasonable control, including acts of God, flooding, fire, pandemic, war, terrorism, failure of utilities or telecommunications, or government action. Where performance is prevented, Offer2Stay will work with both parties in good faith to reschedule or issue a refund of any pre-paid amounts less non-recoverable costs.

All content on the Platform created by Offer2Stay — including our logo, branding, software, text, and design — is the intellectual property of Offer2Stay Ltd and may not be reproduced without our express written permission.
By posting content on the Platform (including listing descriptions and photos), you grant Offer2Stay a non-exclusive, royalty-free, worldwide licence to use that content for operating and promoting the Platform. You retain ownership of your content and may request its removal at any time.
10.1 What cannot be excluded. Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any breach of the terms implied by the Consumer Rights Act 2015 that cannot lawfully be excluded; or (d) any other liability that cannot lawfully be excluded or limited.
10.2 Role of the Platform. Offer2Stay acts as a marketplace connecting guests and hosts. Subject to clause 10.1, and to the fullest extent permitted by law, Offer2Stay is not liable for:

Where you are a consumer, this cap does not affect your rights under the Consumer Rights Act 2015 in respect of services performed by Offer2Stay with reasonable care and skill.
We collect personal data as described below to provide and improve the Platform. By using the Platform, you consent to our processing of your personal data in accordance with this policy and applicable UK data protection law.

Your rights: Under UK GDPR, you have the right to access, correct, delete, or port your personal data; to object to processing; and to withdraw consent. Contact us at enquiries@offer2stay.co.uk. Data retention: We retain your data for as long as your account is active and for up to 7 years thereafter.
We may update these Terms from time to time. We will notify registered users of material changes via email or a prominent notice on the Platform at least 14 days before changes take effect. Continued use of the Platform after that date constitutes acceptance of the revised Terms.
14.1 Informal resolution. If you have a complaint or dispute, please contact us first at enquiries@offer2stay.co.uk. We aim to acknowledge complaints within 2 business days and resolve them within 14 business days.
14.2 Between guests and hosts.Disputes between guests and hosts (e.g. property condition, damage claims, refund disagreements) should first be raised through the Platform's messaging system. If the parties cannot agree, either party may request Offer2Stay to mediate. Our mediation decision is advisory, not binding.
14.3 Formal proceedings. If informal resolution fails, disputes may be referred to the courts of England and Wales (see section 15). Nothing in these Terms limits your right to bring a claim in any court with jurisdiction under applicable consumer protection legislation.
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where you are a consumer resident in Scotland or Northern Ireland, in which case the courts of those jurisdictions may also have jurisdiction.
